House rent Agreement format

LEAVE & LICENSE AGREEMENT

                                                            THIS  AGREEMENT  OF  LEAVE  &  LICENSE  made  this  15th  April, 2013 between , ---------------------------- (having Their contact address)  at  : . --------------------------------------------------------------------------------------------------------------------------- (hereinafter called the  ‘LICENSOR’ which expression shall, unless excluded by or repugnant to the content include their heirs, successors, executors, administrators, legal representatives and assignees) of the ‘ONE PART’
And


-----------------------------------------, (having their contact Address) :- --------------------------------------------------------------------------.
 (hereinafter called the ‘LICENSEE’ which expression shall Include their successors and assignees)  on the ‘OTHER PART’.

WHEREAS  the Licensor is the owner of the premises of House situated on land bearing  :---------------------------------------------------------------------------------------------------------------------------------

   AND WHEREAS the licensee has approached the Licensor to give the said premises on the leave and License basis for the use and occupation by the Licensee for residential use only, which the Licensor has agreed to do on certain and conditions.
  AND WHEREAS the parties to are desirous of recording the terms and condition of License As follows  and which are agreed by both the parties:-

  1. The Licensor hereby to the Licensee a bare, leave and License to use and occupy the said -------------------------------------------------------------------------------------------------------------------- (hereinafter referred to as the LICENSED PREMISES ).
  2. The said property is given to the Licensee for residential purpose and except this no other type of work to be done in the said property
  3. The  License for  shall come from 15th  April, 2013  and shall be valid for a period of 11  month 29 days.
  4. The License hall during the term of the License continue to by the Licensor and Licensee fee of compensation of Rs.13000/-(Rupees Thirteen thousand only) per month including maintenance in the name of for the use and occupation of the License premises. The said Licensee fee shall be payable in advance  and Refundable Security deposit of Rs 26000/-(Rupees Twenty Thousand Only) before the possession of premises.
  5. Rent will be paid in the first week of the month .
  6. Original Electricity bill paid receipt also submit to the licensor.    
  7. All charges for electricity, maintenance, other charges of the licensed premises shall be borne by the licensee. Any sweeper charges for drainage pumping overflow cleaning  in the back side of the flat will be paid by licensee.
  8. The right hereby granted to the Licensee is purely a personal right of occupation and the Licensee shall not assign, transfer or in any manner part with the possession of the Licensed premise or any portion thereof during the term of the agreement.
  9. The License hereby granted is condition on the licensed premises being used for residential purpose.
  10. Nothing herein contained shall be constructed as creative any right , interest , easement, tenancy, or subtenancy or any other right or title in favor of the Licensee, in over or upon the Licensee  premises or as transferring any interest therein favour of the Licensee other that the permissive right of use hereby granted or as entitling the Licensee to possession of the Licensed premises.
  11. The Licensor shall at all times be in exclusive possession and in full charge and in control if the licensed premises. It is the express intention of the parties hereto that this Agreement shall be a mere License and the Licensor shall have at all reasonable time free and unobstructed to access to the licensed premises.
  12. The Licensee shall not do any act or deed which may cause nuisance or annoyance to the Licensor or to the owners or occupants of neighboring premises.
  13. The Licensee shall hand over vacant possession of the Licensed premises to the Licensed on termination of this Agreement in the same condition as that were at the commencement of this License, reasonable, wear and tear accepted and the Licensor will return the amount of deposit after the termination of the contract.
  14. The Licensee shall not carry structural alterations or make any addition or changes in the Licensed premises without the prior consent in writing from the Licensor.
  15. The Licensee shall keep the Licensed premise and the Licensor’s electrical sanitary and plumbing therein in good and tenable conditions.
  16. In the event of Licensee making default in payment of the monthly compensation or committing a breach of the terms and condition of this Agreement, the Licensor will be entitled to terminate this License by giving licensee 15 days notice in writing.
  17. The license shall on expiry or earlier termination of the License, hand over vacant possession of the licensed premises to Licensor clearing all dues, if any, payable by the Licensee hereunder.
  18. The licensee shall bear the current day – to – day minor repairs and maintenance to said premises.
  19. It being the express intention of both the parties that this purely Leave and License Agreement and nothing herein contained shall constitute any tenancy or sub tenancy between the licensor and the Licensee.
  20. Licensee shall not keep any hazardous or inflammable goods or articles except small quantity for normal use premises by law nor shall carry out only kind of antisocial activity in the premise which is prohibited by the society or the law.
  21. List of furnitures and fixtures include  6 tube lights, 4 bulbs, 1 fan, folding attached dining Table, 2 showcase, 1 big TV showcase and slabs , 1 cooler, 2 double bed, and 4 fan regulators.
  22. In case any articles of furniture, furnishing, fixtures & fittings etc. is destroyed or damaged, beyond repairs due to any fault or negligence, of the Licensee, the Licensee shall replace the same by new article of the identical description at his own cost.
  23. Save as aforesaid on expiry of the period of use the Licensee shall hand over back all the furniture, fixtures and fittings etc. in the same condition in which the same was hired after renewing / replacing and polishing to the satisfaction of Licensor.
  24. This License can be terminated by giving clear 15 days notice by either party in writing .
  25. Licensor shall have an option to renew this agreement for another interval of 1 month s and if this agreement be renewed further, the License fee will be increased by 10 % cumulatively.
             
         IN WITNESS WHERE OF THE LICENSOR AND THE LICENSEE HAVE HERE TO SET THEIR HANDS IN THE DAY AND YEAR FIRST WRITTEN ABOVE IN THE PRESENCE OF ALL MIGHTY GOD.
